BOOK YOUR EVENT General sales and user conditions

Introduction

By becoming a member of Book Your Event, you agree to accept the current user conditions. If you do not accept the general sales conditions, you should not subscribe to Book Your Event. Inscription in one or more services as well the use of the site assumes full and complete agreement by the subscriber. Partners agree to furnish all graphical elements relating to their business : logos, designs, photos and videos, text in French, English and Italian. They will ensure they have all rights of reproduction. Book Your Event will not be held responsible in case of litigation.

Article 1 - Inscription in BOOK YOUR EVENT

To become a member of Book Your Event, you need to fill in all required sections within the inscription forms. You confirm that all details you share with us are accurate and correct. You agree to furnish a real email address of which you are the owner. In case of non-receipt of service messages that Book Your Event may have sent, you renounce all rights to claims and/or legal action against BOOK YOUR EVENT
After inscription, you have will have one or more log ins and confidential passwords. These should not be communicated or shared with third parties. On no occasion will BOOK YOUR EVENT be held responsible for the loss of your log in and/or password
In case of use of these elements other than the use for which they are intended, BOOK YOUR EVENT reserves the right to close your account without advance notice. You will have sole responsibility for the use of these elements of identification by third parties as well as the actions and statements made on your account, whether they be false or not. You will indemnify BOOK YOUR EVENT against any relating claims
Moreover, BOOK YOUR EVENT, having no means to ensure the identity of persons registering for their services, will not be held responsible in case of identity fraud by a member. If you think someone is using your account or your identity, you need to inform us immediately by post at the address below. If a member wishes to sponsor a company and provides their contact details to BOOK YOUR EVENT, they agree to obtain beforehand the acceptance of this company to the use of this data by BOOK YOUR EVENT. Furthermore he will be sole responsible for the consequences to this person and third parties of provision of this data to BOOK YOUR EVENT
In accordance with articles L 121-19 and L121-20 of the French Consumer Code, you are informed that you are entitled to a period of seven calendar days, from the date of subscription, to exercise your right of withdrawal without penalty and without cause. Nevertheless, and in accordance with article L121-20-2-1 of the French Consumer Code, this right of retraction cannot be used if you have accessed the features concerned. BOOK YOUR EVENT reserves the right to refuse an inscription request from a supplier or organiser without having to justify their decision.

Article 2 - Use of BOOK YOUR EVENT

Once inscribed, you will have access to the BOOK YOUR EVENT services. The price and payment methods for the different services are available on the BOOK YOUR EVENT website during the presentation and the use of the services to which you wish to subscribe.
For the use of BOOK YOUR EVENT you will agree in particular to respect the following rules: You will abide by the laws that apply and respect the rights of third parties as well as the current provisions . To behave fairly towards BOOK YOUR EVENT and other users.
You will respect intellectual property rights related to the contents produced by BOOK YOUR EVENT and other users. You will never use any feature of BOOK YOUR EVENT other than for the use for which it is intended. You will not overload the service in any way whatsoever. In particular you will not upload more than 100 BOOK YOUR EVENT pages on the same day without our written authorisation
You will only communicate to BOOK YOUR EVENT and other users, such information which you consider can be transmitted without detriment to yourself or others
You will not post any data or contents non-compliant with the facts
You will not post any data or contents that violates the rights of others or any content of a defamatory, insulting, obscene, offensive, violent nature or capable of inciting others to violence, nor content of a political, racist or xenophobic nature and in general all content contrary to the purpose of BOOK YOUR EVENT or any applicable law and regulations
You will not post any data or contents that would diminish, disorganise or hinder the normal use of BOOK YOUR EVENT, nor interrupt or slow down the normal communication between members. You will not participate directly or indirectly in a network using 'snowball' sales or service methods as laid down in articles L122-6 and L122-7 of the French Consumer Code. You will not particpate directly or indirectly in the setting up or developement of a network related to a sales network (MLM). Moreover it is prohibited to recruit Independent Door-to-Door Salespersons to develop such a network or other similar practices
In case of failure of one or more of these rules by a member, BOOK YOUR EVENT reserves the right to terminate the contract without notice, to block the account(s) of the member concerned, to automatically delete the offending messages, to prevent the publication of all or a part of a members profile, and/or block his access to all or part of the services, whether temporarily or permanent, without compensation. In any event, following a permanent closure of an account by BOOK YOUR EVENT, the user will not be reimbursed for any monies paid,
BOOK YOUR EVENT cannot be held responsible for false declarations made by a member. BOOK YOUR EVENT is discharged of all responsibility for meetings between members of BOOK YOUR EVENT on BOOK YOUR EVENT or meetings between members and/or non-members, following the use of the site and its services.

Article 3 - Advertisers Space

The BOOK YOUR EVENT website respects your privacy and has made a declaration to that effect to the French authority for the protection of personal data (la Commission Nationale de l'Informatique et des Libertés - CNIL). As such, BOOK YOUR EVENT remains the sole decision maker as regards the online contents of BOOK YOUR EVENT and can decide unilaterally to not publish or delete a campaign that contravenes the principles listed above. The information likely to be collected on BOOK YOUR EVENT is exclusively intended to grow your professional network.

Article 4 - Confidentiality of your data

BOOK YOUR EVENT concedes you the rights of use solely in digital format on your computer in order to visualise the pages consulted through your browser software. A paper copy is authorised for exclusive private use by the copier, as provided for in article L.122-5-2° of the Intellectual Property Act. All other use is prohibited without the written authorisation of BOOK YOUR EVENT;
In particular you are probited the right to change, copy, reproduce, download, broadcast, transmit, commercially exploit and/or distribute in anyway whatsoever the website pages of www.bookyourevent.fr or the computer code composing the services and the website www.bookyourevent.fr

BOOK YOUR EVENT has a licence to the intellectual property rights relating to the contents supplied by the members in order to publish on the www.bookyourevent.fr website. This licence comprises in particular the right for BOOK YOUR EVENT to reproduce, represent, adapt, translate, digitise, use for publicity purposes, commercial or not, to sub-licence or to surrender contents relating to you (date, description, etc)

Article 6 - Subscription duration - Account Resiliation

The duration of the subscription is 1 year from the date of payment of the total annual subscription. Your account and your personal data will be deleted within 24 hours. In any case a request for account termination does not entitle you to a refund of the period left till the end of the subscription. In case of violation of current user conditions, BOOK YOUR EVENT reserves the right to suspend or cancel your account with prior notice or reimbursement.
This cancellation will be without prejudice to the damages and interests BOOK YOUR EVENT or its beneficiaries and legal representatives may claim against you for reparation of the prejudice suffered through such failures.

Article 7 - Responsability

The data supplied by a member must be accurate and conform with the facts. The consequences of their being published, on your life and/or those of other members, are exclusively yours. You will forego any claims against BOOK YOUR EVENT, particularly on the basis of any harm done to your image rights, your honour, resulting from the transmission or disclosure of any information relating to you.
BOOK YOUR EVENT will not be held responsible for the accuracy or inaccuracy of data and contents furnished by other members, visitors to the side and/or yourselves. Similarly, BOOK YOUR EVENT will not be held responsible for contents posted by a member possibly contravening the rights of one or several other members.
The quality of the www.bookyourevent.fr website required by BOOK YOUR EVENT as well as its members, implies a certain respect in the statements and behaviour of members, respect for the rights of third parties, as well as a respect for current laws and regulations. In order to service this requirement for quality, individual responsibility and ethics, BOOK YOUR EVENT allows any member to notify him on the www.bookyourevent.fr website of any data (pictures, text), behaviour or suggestion by a member which infringes on current laws and regulations, or harms the image or purpose of BOOK YOUR EVENT, the rights of third parties or morality. In consequence, members recognise and accept that the data they supply, as well as their behaviour or statements can be notified by other members and become subject to restraint and/or control by BOOK YOUR EVENT based on objective assessment criteria.
In case this notification or control reveals a failure by a member to adhere to current laws and regulations or to his contractual obligations, current conditions of use - specifically article 5 - "account resiliation" may be applied In case BOOK YOUR EVENT is pursued because of the failure of a member to adhere to his legal obligations or the conditions of use, this member undertakes to indemnify BOOK YOUR EVENT against any conviction, this undertaking covering any damages to be paid as well as legal costs incurred.

Article 8 - BOOK YOUR EVENT Operation

You need to have the ability, the material and software required to use internet and recognise that the characteristics and restraints of Internet do not allow to guarantee the security, availability and integrity of data transmission on the internet.
BOOK YOUR EVENT does not guarantee that the service will run without interruption or operating error. In particular, operations may be temporarily suspended for maintenance, updates or technical improvements, or to change the content and/or layout. As far as possible, BOOK YOUR EVENT will inform its members prior to maintenance or an update. You will not hold BOOK YOUR EVENT responsible for the operation and use of the www.bookyourevent.fr website. Similarly you will not hold BOOK YOUR EVENT responsible for the malfunction, connection problems, or adverse conditions of usage of the BOOK YOUR EVENT website due to incorrect hardware, to interruptions attributable to the member's access provider, to Internet network congestion, and/or any other reason out of BOOK YOUR EVENT's control
BOOK YOUR EVENT will not be held responsible in anyway for any consequent damages suffered and especially loss of data (including copies) or of records that you may have kept.
Over and above legal restrictions, BOOK YOUR EVENT undertakes to never divulge to third parties any personal data regarding their organiser members
In particular, the details of your address book, the list of your direct contacts, your communications on the website (emails, notices, introductions, etc) are confidential and can only be accessed by those involved in these communications.

Article 9 - Changes to BOOK YOUR EVENT

BOOK YOUR EVENT reserves the right to change or update at any time the www.bookyourevent.fr website pages, the services, prices or terms of use applicable.
The changes apply once they are online on the www.bookyourevent.fr website without prejudice to the opportunity of any member to terminate their subscription
In absence, you will be assumed to have accepted these changes by continuing to use the www.bookyourevent.fr website. Members are therefore invited to consult the most recent version of the site online. The presence of a member on the website implies his full acceptance of all revisions or changes to the www.bookyourevent.fr website.

Article 10 - Applicable law - Jurisdiction

These terms and conditions are governed, interpreted and applied according to French law, and the version in the French language will be used in the case of any dispute or claim arising from the meaning of any term or these terms and conditions of sale and use. Subject to public policy applicable, only the jurisdiction where BOOK YOUR EVENT is headquartered shall be considered competent for all litigation relating to these present terms of use, including, but not limited to, their validity, their interpretation, their implementation and/or their termination and the consequences thereof
